Just looking for a bit of advice. My son is 3 next month and is recently had his paediatrician appointment they have diagnosed him autistic I had a letter back today saying that they decline the DLA because he’s not 3 yet and that his needs don’t meet the requirements. His nursery done the forms with me I’m thinking maybe they wer done to early…. Am I right in thinking I should appeal this and gets all the necessary paper work to post off with it?

I’m Kayleigh, one of the parent supporters at Netmums. I’m sorry to hear that DLA was declined for your son, you do have a right to challenge the decision. Citizen’s Advice have some guidance about challenging a decision here: https://www.citizensadvice.org.uk/benefits/sick-or-disabled-people-and-carers/disability-living-allowance/dla-appeals/DLA-appealing-the-decision/


Citizen’s Advice does advise that it can be more difficult to be awarded DLA for a child under 3, because there is a high level of care needed for all children of this age; it can be difficult to evidence the extra care you are providing. This can mean having to be more specific about the care you are providing, there is an example of wording on their webpage for you to have a look at.

thanks for your helpful response, yes I believe I have a month from the date on the letter if I disagree with there decision. I will definitely check out the link you provided.
